Dear Client,
Thank you for engaging Quotax Consultants to act on your behalf.
Before commencing any work, we outline below the general terms on which we accept instructions. These terms apply not only to the current matter but to any future engagements unless varied in writing.
Scope of Work
This engagement relates to accounting and tax services, particularly the preparation and lodgement of individual income tax returns. If further matters arise, we will inform you of the relevant professional responsible for managing your affairs. From time to time, other staff may assist in the delivery of services as appropriate to the complexity and urgency of the matter.
Fees and Billing
Our fees are calculated based on the time and complexity of the work undertaken. Different hourly rates apply to partners, senior staff, and support personnel as outlined in the attached rate sheet. Fixed fee quotes may be provided where appropriate.
Unless otherwise specified, our fees are exclusive of GST.
You acknowledge that our fee is not determined by any statutory fee scale unless expressly stated. We recommend seeking independent advice if you have concerns regarding this.
GST
All professional fees and applicable disbursements will be subject to Goods and Services Tax (GST). You agree to pay the GST component on all invoices.
Advance Payments
In certain circumstances, we may request advance payment for fees or disbursements. Failure to make such a payment may result in the termination of our services.
Cost Estimates
We can provide an estimate on request; however, the actual costs may vary depending on the scope of work. You may request an updated estimate at any stage during the engagement.
Invoicing and Payment Terms
Invoices are issued on a regular basis. Payment is due within seven (7) days of the invoice date. An administration fee of $30 may apply to accounts that remain unpaid for more than 30 days .
If unpaid invoices are referred to a collection agency or legal representative, you will be liable for all associated recovery costs.
Conflicts of Interest
We will not knowingly act in a matter involving a conflict of interest. Should a conflict arise, we may withdraw from the engagement.
Client Cooperation
You agree to:
Respond to our communications within a reasonable time;
Provide complete and accurate information;
Pay all invoices and requested advances promptly.
Failure to comply with these obligations may result in termination of our services.
Authority and Trust Funds
You authorise us to:
Apply any funds received from you (unless for a specific purpose) toward outstanding invoices after 7 days;
Request third parties (e.g., the ATO) to deposit refunds directly into our trust account if necessary.
Third Party or Joint Instructions
If you instruct us on behalf of others, or jointly with others, you agree to remain personally liable for our fees and disbursements, regardless of any third-party arrangement.
File Retention and Destruction
We retain client files for seven (7) years following the completion of work. After this period, files may be securely destroyed unless collected by you.
Termination of Engagement
You may terminate this engagement at any time by written notice. You will remain liable for all fees and expenses incurred up to the termination date.
We may also terminate the engagement if our terms are not met, including non-payment of fees.
Use of Third Parties
Where necessary, we may engage external professionals on your behalf (e.g., legal or valuation services), after consultation with you regarding their terms and fees.
Feedback and Complaints
We welcome all client feedback. Should you have concerns about the conduct of your matter, please contact our Principal, Touqeer Fazal, at your earliest convenience.
Indemnity Statement
You agree to indemnify Quotax Consultants (including its directors, employees, and representatives) against any liability arising from the conduct of services rendered under this agreement, including but not limited to penalties, tax assessments, and costs arising from incorrect or incomplete information provided by you.
You release and waive any claim against us in respect of losses suffered due to:
Incorrect data or late provision of information;
ATO penalties or reassessments;
Actions or omissions by third parties;
Judicial decisions affecting your financial or tax affairs.
These are the terms on which we are prepared to act. Please confirm your acceptance by signing below and returning a copy to us. By continuing to instruct us, you agree to be bound by these terms.
